I. Position and function:
1. Vung Ang Economic Zone Authorities (hereinafter call VAEZ) is a state administrative agency under the management of Hatinh Provincial People’s Committee (PPC) to implement the central and management to harmonize all activities related to investment, construction and economic development in VAEZ and other industrial zones in Hatinh province in accordance with operating regulations, master plan and implementing progress that have been approved by authorized agencies.
2. VAEZ has its own legal status, bank account and stamp with coat of arms on, head office, personnel, operating budget, and investment capital for development granted by the Government from the National Budget in accordance with yearly operating plan. It is a planning body that has its own investment capital for development allocated from the National Budget.
II. Duties and authority:
VAEZ organizes the implementation of duties and authority as stipulated (referred to) in the Article 27 of the Regulation on the Industrial, Processing and High-tech Zones promulgated in accordance with the Decree No. 36/CP dated 24 April, 1997 of the Government. All specific duties and authority are stipulated in the Article 29 in the Operating Regulations of Vung Ang Economic Zone promulgated in accordance with the Decision No. 72/2006/QD-TTg dated 03 April, 2006 of the Prime Minister. Some duties and authority of VAEZ as stipulated in Regulations of Government Ministries and Sectors and Provincial People’s Committee on areas of operation in Vung Ang Economic Zone in the authority and management of VAEZ are as follows:
1. To take the main responsibility in coordination with other relevant authorized agencies in the province to establish the general master plan for Vung Ang Economic Zone and other industrial zones so that Provincial People’s Committee (PPC) can submit to the Prime Minister for final approval; to make the specific master plan for functional areas, land use plan in Vung Ang Economic Zone and specific master plan for industrial zones to submit the PPC for approval. To organize the management, to guide the implementation, inspection and check the construction implementation, land use plan and master plan in VAEZ and other industrial zones.
2. To build the List of Investment projects and plan for capital construction investment every year to submit to the authorized agencies for approval to organize the implementation. To manage and make the use of investment funds for development; organize the appraisal of investment projects to submit authorized agencies for approval.
3. To organize the appraisal process of infrastructure investment and business projects in industrial and functional areas in VAEZ in accordance with development orientation approved by authorized agencies.
4. To have rights to sign BOT, BTO, BT contracts and others as stipulated in current regulations. Moreover, it is the agency that directly receives, manages and uses ODA funds and other funds to invest in the development of Vung Ang Economic Zone and other Industrial zones in accordance with current regulations.
5. To issue, adjust, manage and revoke following licenses, certificates and certificates of affirmation of all kinds:
a) Licenses for the establishment of trade representative offices and branches of foreign organizations and businesspeople in Vung Ang Economic Zone and industrial zones;
b) Certificates of business registration for organizations and individuals to set up enterprises in Vung Ang Economic Zone and industrial zones;
c) Investment certificates and incentive investment certificates for foreign direct investment projects and investment projects in Vung Ang Economic Zone and industrial zones in accordance with the stipulated authority or delegation of power;
d) Planning certificates, construction licenses, certificates of origin for goods in Vung Ang Economic Zone and industrial zones;
e) Work permits for foreigners and Vietnamese settling abroad to work or invest in Vung Ang Economic Zone and industrial zones as stipulated by the laws;
f) Permits and licenses, certificates of all kinds under VAEZ authority or are delegated with full power by Ministries as stipulated by the laws.
6. To approve the import plans of foreign invested enterprises; confirm the list, quantity of raw materials, materials, spare parts and semi-finished product that will be imported each year for the operation of production projects of foreign and domestic organizations and individuals in Vung Ang Economic Zone and industrial zones.
7. To approve the liquidation of machines, equipment, means of transport and materials of foreign invested enterprises in Vung Ang Economic Zone and industrial zones.
8. To manage natural resources and environment:
a) To appraise and approve evaluation reports on environmental impacts or confirm environmental standards certificates of investment projects in Vung Ang Economic Zone and industrial zones based on authority;
b) To manage and check the implementation of environmental protections in Vung Ang Economic Zone and industrial zones, to coordinate or propose authorized agencies to deal with those who violate regulations on environmental protection in Vung Ang Economic Zone and industrial zones.
9. To carry out Land use management in Vung Ang Economic Zone
a) To have rights to grant rented land and free-rent land, to allow individuals and organizations to lease land and water areas in Vung Ang Economic Zone with right land use purposes as stipulated by the law;
b) To decide the rate of land and water use rental (levies) and land and water lease rental, rates of land-water use and lease exemption and reduction depending on each project in Vung Ang Economic Zone on the basis of land prices and land exemption and reduction policies of the PPC and lawful regulations for situations of land reassignment and land lease not through auction of land use rights or tenders for land use projects;
c) To have power to organize bid for land use rights and land use projects on the basis of financial measures and prices approved by the PPC to reassign and lease land and water areas that have been compensated after site clearance out to individuals and organizations in need as stipulates by the Land Law;
d) To coordinate with local authorities and relevant agencies to implement the site clearance and compensation for the areas of land and water that have been withdrawn by relevant authorized agencies so that these areas of land and water can be under the management of VAEZ and VAEZ can reassign and lease these areas out to individuals and organizations in need and to carry out resettlement for households whose land have been withdrawn as stipulated by the land laws.
10. To manage national budget and fees:
a) To manage investment capitals from the national budget, from management budget, administrative incomes and expenditures, programs and other funds from the government in accordance with the laws;
b) To build the price, fee and levy frames implemented in Vung Ang Economic Zone and industrial zones and the submit to authorized agencies for consideration and issuance in accordance with the law;
c) To collect fees or levies of all kinds, manage and use them in accordance with the law.
11. To organize promotion activities of investment, trade, tourism, services, marketing and business negotiation at home and abroad; to build programs for investment, trade, tourism and service promotion and incentive policies in Vung Ang economic Zone and industrial zones to submit authorized agencies for approval and organization of implementation.
12. It is the agency that solves all problems arising after the issuance of investment certificates and from the establishment and implementation of investment and production projects as well as other activities in Vung Ang Economic Zone and industrial zones.
13. To coordinate with local authority and relevant agencies to ensure security and social order, to carry out fire preparedness and firefighting activities as well as other activities in Vung Ang Economic Zone and industrial areas in accordance with operating regulations of Vung Ang Economic Zone and of the laws.
14. To carry out checks and inspections to foreign and domestic individuals and organizations implementing their business, production and services activities in Vung Ang Economic Zone and industrial areas in accordance with lawful regulations, to solve administrative complaints, accusations and disputes in Vung Ang Economic Zone and industrial zones on the basis of its authority and delegation of power.
15. To take the main responsibility in coordination with relevant agencies to train and improve professional capacity for officials and civil servants.
16. To admin mechanism, personnel, finance, and asset… of the Management Unit of Vung Ang EZ in accordance with laws regulation.
17. To admin and steer the operation of non-productive and business entities which are directly thereunder.
18. To co-ordinate with bodies who function labour administration to check, inspect the obedience of law regulations on labour collective agreement, labour contracts, labour safety and sanitary; To co-ordinate with relevant bodies to organize training to and supply of labour services to business entities in Vung Ang EZ and other Industrial Zones.
19. To act as a contacting body for science and technology planning; To organize and steer the implementation of plans for scientific studies and the application of science and technology advances to reality in sub units of the Management Unit of Vung Ang EZ.
20. To report on periodical and urgent basis on master planning, construction plan, situation of operation and administration in Vung Ang EZ and Industrial Zones in accordance with state regulations and on requests of the Provincial People’s Committee and relevant bodies and industries.
21. To chair, coordinate with relevant bodies to implement administrative reforms through “one stop” regime on different operation sectors in Vung Ang EZ and Industrial Zones;
22.To Administer in some other sectors:
a) To chair, coordinate with relevant bodies in steering the maintenance of the system of socio-technical infrastructures, service and public service facilities in Vung Ang EZ and Industrial zones
b) To evaluate and propose for rewards to achievements, disciplines, administrative punishment in accordance with laws.
c) To conduct international cooperation in accordance with laws.
23. To implement other duties on the assignment of the Government Prime Minister and the Chairman of the Provincial People’s Committee in a certain period.
